Vacations to Courts is the legacy of the colonial rule - Supreme Court has 193 working days annually and High Courts 210 days Is it not time to discontinue long vacations for courts, especially the Supreme Court when the Indian judiciary is grappling with backlog to the tune of a whopping 3.3 crore cases across the country ? Right to speedy justice is a fundamental right guaranteed under Article 21 of the Constitution. Public Interest Litigation filed questioning Why does Supreme Court work for only 193 days in entire year ?The system of vacations is legacy of the colonial rule. The situation as the country is facing demands that courts should do away with such long vacations. Every court, including apex court, must function at least six hours per day and 225 days per year, said the PIL. Even seven decades after independence, the system of long vacations for courts - a practice introduced by the British in India to allow their judges ample time to travel home and back - continues.

Justice Ujjal Bhuyan was sworn in as the Chief Justice of Telangana High Court on Tuesday in a Ceremony held at Raj Bhavan here. Governor Tamilisai Soundararajan administered the oath of office to Justice Bhuyan. Chief Minister K Chandrashekar Rao and some of his cabinet colleagues, Union Minister G Kishan Reddy and senior officials were present on the occasion. Born on August 2, 1964 in Guwahati, Justice Bhuyan was appointed as Additional Judge of Gauhati High Court on October 17, 2011 and confirmed on March 20, 2013. He was transferred to Bombay High Court and took oath as judge on October 3, 2019. The judge was transferred to Telangana High Court on October 22, 2021. Founded by the 7th Nizam Mir Osman Ali Khan, initially, the Telangana High Court was set up as High Court of Hyderabad for the then Princely State of Hyderabad Deccan and later renamed High Court of Andhra Pradesh, as it was set up on 5 November 1956 under the States Reorganisation Act, 1956. From 2 June 2014, after the Andhra Pradesh Reorganisation Act, 2014 came into force, it was renamed and served as a common high court for both of the states until 1 January 2019. A separate high court was established for Andhra Pradesh and inaugurated on 1 January 2019 and it was named as Andhra Pradesh High Court. The seat of the high court is in Hyderabad and has been sanctioned for 24 judges.

Punjab & Haryana High Court : Muslim girls over 15 years can marry as per the Muslim Personal Law

Referring to Article 21 of the Constitution, the Punjab & Haryana High Court held that the Constitution provides for protection of life and personal liberty. A Muslim girl over 15 years of age is competent to marry a man of her choice, the Punjab & Haryana High Court has ruled. Holding that the "marriage of a Muslim girl is governed by the Muslim personal law", the High Court in an order passed last week granted police protection to a newly-wed Muslim couple. Citing that order, the HC said "in the case of Yunus Khan it has been noted that the marriage of a Muslim girl is governed by the personal law of the Muslims" Muslim Personal Law.

Telangana High Court’s current Chief Justice, Satish Chandra Sharma, has been transferred to the Delhi High Court. The government also announced the appointment of four other new Chief Justices in the country. Justice Ujjal Bhuyan was a judge in the Bombay High Court, where he worked for two years before being transferred to the Telangana High Court in 2021. He enrolled in the Bar in 1991 and practiced before the principal seat of the Gauhati High Court, the Central Administrative Tribunal, Guwahati Bench, and the Assam Board of Revenue. Justice Bhuyan was appointed as Additional Judge of Guwahati High Court on October 17, 2011, and confirmed on March 20, 2013. Protection of Women from Domestic Violence Act, 2005

The offence of domestic violence is committed by someone in the victim’s domestic circle. It includes family members, husband, relatives, etc. The term domestic violence is often used when there is a close cohabitating relationship between the offender and the victim. The various forms of domestic violence include senior abuse, child abuse, honour-based abuse such as honour killing, female genital mutilation, and all forms of abuse by an intimate partner.  The Act plays a critical role in the Indian legal system vis-a-vis protecting the rights of the women, so that they can feel protected and safe within the comfort of their own house. It is an exhaustive piece of legislation as it lays down the powers and duties of the various authorities, reliefs available to the victims, steps to filing a complaint regarding domestic violence, assistance provided to the victims of domestic violence, power and extent of the Indian Judiciary and the power of the Central Government to make rules. The Act provides civil remedies to the victims of domestic violence. And prior to the enactment of the Act, the victims of domestic violence sought civil remedies such as divorce, custody of children, injunctions in any form or maintenance only by taking recourse to civil courts. Therefore, the Act brought about necessary changes in the Indian legislature.

Understanding the Pocso Act

Protection of Children from Sexual Offences Act, 2012. Pocso Act defines a child as any person below the age of 18 and defines different forms of sexual abuse including penetrative & non-penetrative assault as well as sexual harassment and pornography. Whoever commits aggravated penetrative sexual assault shall be punished with rigorous imprisonment for a term which shall not be less than 20 years, but which may extend to imprisonment for life, which shall mean imprisonment for the remainder of natural life of that person and shall also be liable to fine, or with death.
